Terms of Service

Educational only: Blakey Trades is a trading-education app. We do not provide financial advice, do not execute trades, and never hold or access your funds. The app does not contain trade signals.

1. Who we are

These Terms are a contract between you and Kyle Airey, a sole trader based in England, trading as Blakey Trades ("we", "us", "our"). By creating an account or using the app, you agree to these Terms.

2. What Blakey Trades is

Blakey Trades is an educational app for gold (XAUUSD) traders, providing:

The app does not contain trade signals, trade calls, or member chat. Telegram is a separate, optional third-party service outside the app. We do not make the app depend on Telegram, and you should assess any third-party content there independently; nothing in this app is personalised financial advice.

Blakey Trades is not a broker, is not authorised or regulated by the Financial Conduct Authority, and does not place, manage, or execute trades on your behalf. Trading leveraged products carries a high risk of loss and you may lose more than your initial deposit. Past performance is not a guide to future results. You are solely responsible for your own trading decisions, and you should seek independent advice from an authorised adviser if you are unsure.

3. Eligibility

You must be at least 18 years old and legally able to enter into this agreement to use Blakey Trades. One account per person. Do not create multiple accounts or share your login.

4. Your account

You're responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorised access.

5. Membership and Telegram channel access

The app itself is free to use and has no in-app purchase flow, recurring subscription, auto-renewing plan, or charge for Telegram/community access. There is therefore no subscription to cancel and no renewal reminder or cancellation window to manage. Any external service has separate eligibility, pricing, cancellation, and access terms. An external payment is not represented as a substitute for any payment method required by Apple or another platform. No app feature requires Telegram access.

If you need factual help with a separate community service, you may contact Blakey Trades Support on Telegram (@blakeytrades_support). The app remains usable without that service.

6. Ask Aria (AI assistant)

"Ask Aria" is an AI assistant, not a human. It generates responses automatically and can be wrong, out of date, or incomplete. Nothing Aria says is financial advice, a recommendation, or a trade instruction, and it must not be relied on for any trading decision. For anything that matters, including account issues, external-service questions, or complaints, contact the human team.

Your message and the recent conversation are sent to third-party AI providers to generate a reply (see our Privacy Policy). If a message suggests an immediate self-harm risk, the server returns a fixed crisis-support response before sending the sensitive wording to a provider; Ask Aria is not an emergency or medical service. Do not put passwords, card details, or other sensitive personal information into the chat. We apply fair-use limits per member per day and may restrict access if the feature is abused.

7. Acceptable use

The app has no member chat, feed, or direct messages. You may create private journal entries and support messages sent to Ask Aria; their handling is described in our Privacy Policy. You agree not to:

If you're aware of misuse, or want to report a problem with the app or an external service, contact us at kyle.airey@hotmail.com. We aim to review reports promptly and may remove content or suspend or terminate accounts where appropriate; urgent safety, legal, or technical issues may require additional time. Conduct inside Telegram is also subject to Telegram's own terms and reporting tools.

8. Content ownership

Your journal entries are yours. They are private, are not made public or displayed to other members, and are handled as described in our Privacy Policy. We do not licence or distribute them.

The app, its design, and its curriculum are owned by us or our licensors. You may use the app for personal, non-commercial purposes only. You may not copy, redistribute, or resell our education content.

9. Third-party services

The app links to and relies on third-party services we don't control, including Telegram (optional community/support) and the AI providers listed in our Privacy Policy. Your use of those services is governed by their own terms. If we refer to a broker or any other third party, we are not responsible for their products, and any such reference is not a recommendation to trade.

10. Termination

You can delete your account at any time (see Account Deletion).

We may suspend or terminate your access or account if you breach these Terms, if we reasonably believe continued access would harm us, other members, or third parties, if required by law or a platform (including Apple or Google), or if we discontinue the app or a material part of it. Where practicable we will give notice. Serious, repeated, or security-related breaches may result in immediate suspension or termination without prior notice.

11. Skill leaderboard

The app may include an optional free daily education quiz and a public ranking of quiz scores (“skill leaderboard”). Scoring and display are described in the skill leaderboard terms. It is not a contest and there is no prize. Apple and Google are not sponsors. No purchase or broker deposit is required. It is educational entertainment and is not financial advice.

12. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law — including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. We do not promise profits, returns, win rates, or any particular trading outcome.

13. Limitation of liability

We are not liable for trading losses you incur based on information or education presented in the app, by third-party services, or by the AI assistant.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss (including loss of profits, data, goodwill, business opportunity, or reputational harm), whether arising in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such loss — for example where a bug, outage, or crash causes data loss or interruption.

To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the app is limited to the amount you have paid us in the 12 months before the claim (or £0 if you have not paid us anything).

Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

14. Indemnification

You agree to indemnify and hold us (and our officers, agents, and contractors) harmless from and against claims, losses, damages, and reasonable legal costs arising out of or related to: (a) your breach of these Terms; (b) your misuse of the app; (c) content you submit (including journal entries, shared cards, support messages, or Ask Aria messages) that is unlawful, defamatory, or infringes someone else’s rights; or (d) your use of third-party services in connection with the app.

This does not require you to indemnify us for our own negligence, fraud, or any liability that cannot lawfully be excluded or limited.

15. Governing law and dispute resolution

These Terms are governed by the laws of England and Wales. Subject to any mandatory consumer protections that apply where you live, the courts of England and Wales have exclusive jurisdiction over disputes arising out of or relating to these Terms or the app.

Before starting formal proceedings, please contact us at the address below so we can try to resolve the issue informally. We do not require mandatory arbitration or a class-action waiver; for a UK consumer education app, disputes are handled through the courts (and any mandatory ADR rights you may have), not forced private arbitration.

16. Changes to these Terms

We may update these Terms as the app evolves. We'll reflect the date at the top when we do; continued use after a change means you accept the update.
