Terms of Service
1. Who we are
These Terms are a contract between you and Kyle Airey, a sole trader based in England, trading as Blakey Trades ("we", "us", "our"). By creating an account or using the app, you agree to these Terms.
2. What Blakey Trades is
Blakey Trades is an educational app for gold (XAUUSD) traders, providing:
- A learning curriculum and video library
- A private trading journal you populate yourself, including screenshot import
- A schedule of live educational sessions, with optional reminders
- High-impact economic news alerts
- Ask Aria — an AI support assistant (see §6)
The app does not contain trade signals, trade calls, or member chat. Our Telegram channels are a separate service where our team posts and discusses their own trading; access to those channels is arranged by contacting our support team on Telegram. Nothing in the app or those channels is personalised financial advice.
Blakey Trades is not a broker, is not authorised or regulated by the Financial Conduct Authority, and does not place, manage, or execute trades on your behalf. Trading leveraged products carries a high risk of loss and you may lose more than your initial deposit. Past performance is not a guide to future results. You are solely responsible for your own trading decisions, and you should seek independent advice from an authorised adviser if you are unsure.
3. Eligibility
You must be at least 18 years old and legally able to enter into this agreement to use Blakey Trades. One account per person — do not create multiple accounts or share your login.
4. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorised access.
5. Membership and Telegram channel access
The app itself is free to use. Our Telegram channels are a separate service, and access to them is arranged by our support team — there is nothing to buy, unlock, or subscribe to inside the app.
To request channel access, message Blakey Trades Support on Telegram (@blakeytrades_support). The team will explain the current access options and onboard you. Access may be reviewed periodically, and we may withdraw it in line with §9.
6. Ask Aria (AI assistant)
"Ask Aria" is an AI assistant, not a human. It generates responses automatically and can be wrong, out of date, or incomplete. Nothing Aria says is financial advice, a recommendation, or a trade instruction, and it must not be relied on for any trading decision. For anything that matters — account issues, channel access, complaints — the human team is available on Telegram.
Your message and the recent conversation are sent to third-party AI providers to generate a reply (see our Privacy Policy). Do not put passwords, card details, or other sensitive personal information into the chat. We apply fair-use limits per member per day and may restrict access if the feature is abused.
7. Acceptable use
The app has no member chat, feed, or direct messages — the only content you create is your own private journal. You agree not to:
- Share your account or use more than one account
- Scrape, republish, or resell our education content
- Attempt to bypass access controls, usage limits, or security measures
- Use the app for any unlawful purpose, or to attempt to defraud or harass anyone
- Use automated tooling against our systems, including the AI assistant
If you're aware of misuse, or want to report a problem with the app or with conduct in our Telegram channels, contact us at kyle.airey@hotmail.com. We review reports and act — including content removal and account suspension or termination — within 24 hours. Conduct inside Telegram is also subject to Telegram's own terms and reporting tools.
8. Content ownership
Your journal entries are yours. They are private, never made public, and readable only by you — we do not display, licence, or distribute them.
The app, its design, and its curriculum are owned by us or our licensors. You may use the app for personal, non-commercial purposes only — you may not copy, redistribute, or resell our education content.
9. Third-party services
The app links to and relies on third-party services we don't control, including Telegram (community and support) and the AI providers listed in our Privacy Policy. Your use of those services is governed by their own terms. If we refer to a broker or any other third party, we are not responsible for their products, and any such reference is not a recommendation to trade.
10. Termination
You can delete your account at any time (see Account Deletion). We may suspend or terminate accounts that violate these Terms without notice in serious cases.
11. Disclaimer & limitation of liability
The app is provided "as is" without warranties of any kind. We are not liable for trading losses you incur based on information or education presented in the app, in our Telegram channels, or by the AI assistant. To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the app is limited to the amount you've paid us in the 12 months before the claim (or £0 if you have not paid us anything). Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
12. Governing law
These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these Terms
We may update these Terms as the app evolves. We'll reflect the date at the top when we do; continued use after a change means you accept the update.
